6 YEARS OF FREE POWER

    I know someone who's electric bill was somehow mistakenly being drafted from someone else's bank account. This person called the power company when it first started and spoke to one of the call center's brightest stars. He was advised he was sent up on auto-draft. The caller inquired more and wanted to know who's account the $$ was coming from because caller had never signed up for auto-pay. The call center agent seemed perplexed that the caller didnt know who's account his bill was being paid with and insisted the caller had to have set it up.

    Fair enough the caller thought and asked that his account be noted that an inquiry had been made.

    9 years later....9 FUCKING YEARS LATER...the power company is also made aware of this mistake by the person who's account had been drafted FOR 9 FUCKING YEARS!!!

    Long story short...the power company refunded the payee 9 FUCKING YEARS worth of payments and can apparently only go back 3 years against the person who had not paid in 9 years. True Story.... :punk:

    If the person who hadn't paid in 9 years didn't make the mistake they shouldn't have to make ANY back payments. That's on the power company.

    The person knew they weren't paying and didn't insist on paying anyway. If all they did was make one phone call 9 years ago, then they should probably just settle for the 6 free years and consider themselves lucky that they don't have to spend a whole lot more to defend themselves from fraud charges.

    fraud???? how could it be considered fraud when it was an internal power company error?

    i dont believe there was much obligation on the person getting it for free to inform them at all.

    The same way it's considered fraud when the bank mistakenly says someone has a million dollars in their account and the person spends it. If you know there is a mistake like that, then you have an olbigation to take reasonable steps to correct the mistake. What is considered reasonable is sometwhat of a gray area, but one phone call in 9 years is squarely outisde that gray area.
